clothpoems.com is based in the United States of America, and is owned and operated by Clothpoems, LLC.

Clothpoems items are made by hand in the USA using luxury quality fabrics and materials.  While some of our products are made using antique or vintage fabrics or components, the finished products are still considered to be in brand new, unused condition—unless noted otherwise in the product description.  We strive to thoroughly note all important details in our product descriptions, so be sure to read them entirely.
The appearance of colors in product photos may vary across different device screens. We cannot guarantee that your screen’s display of any color will be an exact match to the actual product, but we do take great care in photographing our products and presenting them as accurately as we can.

Customer Requirements

To place an order at clothpoems.com, you must be at least 18 years of age; you must not be legally prohibited from accessing this website or any of the website’s content, products or services; you must agree to our Store Policies as stated here and elsewhere throughout our website; you must agree to our Terms of Service; and you must be a “Final Customer”–see the following section for details.

Final Customers

This website was created and published for the purpose of offering our merchandise and services directly and exclusively to our individual customers.
The products sold on clothpoems.com are intended to be sold to the Final Customer.
By “Final Customer” we mean a person or entity who does not purchase our products for purposes that may include but are not limited to, the re-selling of our products via their own entrepreneurial activity or professional business.
Therefore, we request users who are not considered a “Final Customer” to refrain from placing orders on our website or from using third-party accounts, web bots, or other tools to forward purchase orders for our merchandise.  In any such cases, we will cancel the order.
We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Returns & Cancellations

Due to the handmade, one-of-a-kind nature of all Clothpoems items, 
Returns are Not Accepted. 
All Sales are Final.
We do not accept order cancellations, so please choose carefully before ordering.
We do not accept returns or cancellations on the basis of unexpected customs fees, so please do your own research regarding tariffs, import fees, etc before making a purchase on our website. Thank you.

Shipping

Shipping costs are calculated at checkout and vary by weight, dimension, and distance.

Once your order is placed, we ship within 2 to 3 business days.

Clothpoems is not responsible if a buyer enters an incorrect or incomplete address, so please carefully enter the correct shipping address when you are checking out. Once an order is accepted by the mail carrier, it is no longer possible to change your delivery address.

Great care is taken to assure that our products are never shipped out in damaged or defective condition. All of our products are very carefully inspected for quality before packaging for shipment, and are then packed with the utmost care. Timestamped photographic and/or video documentation is taken at the time of packaging your order for shipment as proof that your order was packaged for shipping in the same condition in which it was originally sold, as shown in the product photographs at the time of sale.
In any case, the acceptance or rejection of customer claims of products being shipped in damaged or otherwise defective condition will remain at the sole discretion of Clothpoems.

When your order has shipped, you will receive a Shipment Confirmation email containing your tracking number.  If you do not see our email in your Inbox, please be sure to check your Spam folder. It is always the customer’s responsibility to keep up-to-date with their order tracking.

Once shipped, packages generally take 3 to 6 days to arrive for domestic orders.    

Clothpoems reserves the right to delay a shipment if the order is not able to be shipped within our standard timeframe for reasons unforeseen or beyond our control.  Please note that during holiday seasons and sales, there may be delays in shipping. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

If a package is unclaimed, undeliverable or refused and returned to us, the customer must pay for new shipping charges if they wish for the package to be resent. 
In the event that a recipient refuses to accept the package, for any reason after shipment, both the return shipping fees and any applicable import fees will be the customer’s responsibility and will be deducted from their refund.

Shipping Insurance

All Clothpoems orders are shipped with insurance coverage for the total item sale value excluding taxes and fees.
Shipping insurance covers damage, loss or theft that may occur during shipment, but does not cover damage, loss, or theft that may occur after the package has been delivered.

Title and risk of loss pass to you, the customer, upon our transfer of your package to the mail carrier.

Clothpoems is not liable for any orders that are damaged during shipment.
If an order is damaged during shipment, an insurance claim can be filed by the customer with the respective mail carrier. Photographic evidence of the damaged package will need to be provided to the mail carrier in a timely manner, so please save all packaging materials and damaged goods before filing your claim with the mail carrier responsible for delivering your order.

Clothpoems is not responsible for any packages that are lost or stolen during shipment or after delivery, so please make sure you are shipping to a secure address.

Once your tracking says your order is “Delivered,” it is no longer the responsibility of the mail carrier, and all responsibility is transferred to the customer.

International Orders

International orders are non-returnable.

Clothpoems ships to several countries outside the USA for a flat fee depending on the weight and size of your order.  

We currently ship to the following countries: the United States, Canada, England, France, Germany, Greece, Ireland, Italy, Japan, Mexico, Netherlands, Scotland, Spain & Wales.
If your country is not listed above, please contact us about shipping availability to your location.

The delivery address of your order must be located in the same country in which you placed your order.
Orders made from a different country than the delivery address will be automatically cancelled.

International shipping usually takes anywhere from 2 to 8 weeks; however, shipping times can vary substantially.
We are not responsible for shipping delays as those are beyond our control.

International shipments are accompanied by an invoice with the exact declared value of each item in US Dollars.  Sale and discounted items will reflect the discounted price.  For tax purposes, the value of items will be declared on the package’s mailing label or insert on all international orders.   

International customers will be responsible for paying any customs fees incurred by the recipient’s country.  Customs fees can be unpredictable and subject to change. 
It will be the customer’s responsibility to resolve any issues regarding customs fees with their local mail delivery service.  Please contact the customs agency in your country for details.

All international taxes, customs fees, VAT fees and import duties will be billed to the recipient by the mail carrier when the package reaches its destination country.  These charges must be paid by the recipient and will not be reimbursed by Clothpoems.  We do not take responsibility for any of these costs and do not offer compensation to cover any of these charges.  If a recipient refuses to pay the taxes, customs or import duties, the package will be considered abandoned and will not be eligible for store credit or refund.

If a package is unclaimed, undeliverable or refused and returned to us, the buyer must pay for new shipping charges if they wish for the package to be resent.  In the event that a recipient decides to not accept their package, for any reason after shipment, both the return shipping fees and any applicable import fees will be the buyer’s responsibility and will be deducted from their refund.

Clothpoems does not accept returns or order cancellations on the basis of unexpected customs fees. Please do your own research regarding tariffs, import fees, etc before making a purchase on our website. Thank you.

Pricing & Currency Conversion

Our products are priced in US Dollars and we only accept payment in US Dollars. 
Credit Card charges for International orders will be debited in US Dollars at the prevailing exchange rate used by the credit card company.  If you require information on these exchange rates, please contact your credit card company.

Payment Security

All eligible customers are welcome to Checkout as Guests on our website, and are not required to register an account with us before making a purchase.
If you choose to make a purchase on our website, we do not save your payment details and your personal information is encrypted using secure socket layer (SSL) technology on an encrypted secure server.  In the event that information is accessed by a third party, not due to negligence on our part, Clothpoems will not be held responsible.  Our entire website including our shopping cart and checkout pages, uses secure protected connections, as shown by the URL prefix “https” and the lock symbol that appears in the web browser’s address bar.

Payment Options

Clothpoems accepts the following methods of payment:

Credit Card

Credit Card options: Visa, MasterCard, Discover, and American Express.

When customers place orders online, credit card details are entered into a protected online payment system provided by WooPayments.

If there are sufficient funds and the account information is valid, the transaction will be processed instantly.
At the moment the order is confirmed, the Credit Card will be charged for available items.

PayPal

Clothpoems gladly accepts payments from PayPal accounts. PayPal is the largest online payment method in the world and also one of the safest.
Clothpoems reserves the right to process orders only if shipped to the same address that the verified PayPal account is registered with.

Google Pay

Use the Google Wallet or Google Pay app to quickly and securely check out.

Apple Pay

Use Apple Pay to easily and securely check out in iOS apps and on the web.

WooPay

WooPayment’s express checkout method, WooPay, allows you to pay in full or split your purchase into regular payments.

Coupons & Discounts

At checkout, a valid coupon discount can be applied once to your order subtotal.  
Coupons cannot be applied to Sale items. The coupon discount will be visible after the code has been successfully entered into the “Coupon” box on the checkout page. Clothpoems will not refund, reimburse or retroactively apply coupon codes that were not used by the customer, for any reason.

Order Processing

Clothpoems reserves the right to decline an order in the event that the order does not receive express verification or approval from the customer’s bank, credit card company or payment processor. 
Once an order is placed for available items, no changes can be made to that order. 
Clothpoems reserves the right to decline to process an order and/or offer services to anyone at any time.


All of the Store Policies outlined above are incorporated into, and made a part of, our Terms of Service agreement.

International Customers

You are responsible for complying with all of the applicable laws and regulations in your country, including the laws and regulations regarding the import of products into your country. You will be the importer of record of products shipped to you from outside of the country to which such products are shipped. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services or any part thereof.

No Waiver

Our choice to not exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. If we choose not to take legal action against a user following a breach of these Terms of Service on their behalf, it does not mean legal action will not be taken if the user commits another act that violates our Terms of Service or other Store Policies, whether the breach is the same or different than the previous one.

Dispute Resolution

If a Dispute is not resolved through Informal Negotiations, you and we agree to resolve any and all Disputes through final and binding arbitration.

Notice of Arbitration

These Terms of Service require you to submit most unresolved disputes to mandatory Arbitration, meaning you agree to submit any dispute related to the website, these Terms of Service, our Store Policies, or Privacy Policy to binding individual Arbitration rather than proceeding in a court of law, except for small claims court.

Governing Law

These Terms of Service and any disputes between us shall be governed by and construed in accordance with the laws of the State of Arizona, USA.

Entire Agreement

These Terms of Service and any other Store Policies or operating rules posted by us on this website or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these Terms of Service).
Any ambiguities in the interpretation of these Terms of Service and Store Policies shall not be construed against us.
